Nicholas Lakeland Ranked in Chambers as Leading Individual for years 2013 and 2014

Nick heads up the Employment and Pensions team in the firm. He has a very wide ranging practice which encompasses both contentious and non-contentious work. He acts for both employers and employees and is frequently asked to advise on the tactics which may lead to a dismissal or a termination of employment which in turn often leading to his being required to assist clients with the preparation and negotiation of settlement agreements. He is therefore particularly well acquainted with the issues arising from negotiating such agreements.

He is regularly asked to draft or advise on employment contracts and service agreements which often include guaranteed and discretionary bonuses, share options, restricted stock units and other forms of incentives. He is also often asked to assist with the review or drafting of company policy documentation generally.

His contentious practice has involved him in a number of reported cases, including Reiner Moritz Associates Ltd -v- Carter [EAT] ICR 1997. In the past year Nick has overseen the Employment team acting for both employers and employees in 25 employment tribunal cases and 3 Employment Appeal Tribunal cases.

Nick has also over the years assisted a number of clients who have been investigated and prosecuted in connection with breaches of health and safety laws.

Examples of matters in which Nick has recently been involved in are:

a very high value disability discrimination claim where damages claimed included a claim for an end of career award;

assisting a high profile international client establish their business in the UK and preparing a suite of employment related documentation;

two cases where Employers had failed to serve and ET3 and judgements in default were entered against them and had to be set aside;

Melanie Stevens -v- The London Borough of Wandsworth which resulted in a maximum award being paid out to the Claimant together with a costs award with the costs being ordered to be assessed by the County Court; the case was appealed in the Employment Appeal Tribunal but was settled on terms;

negotiating and agreeing a settlement package on behalf of an employer where the alternative was facing a claim in the employment tribunal;

Nick acts for clients in a very wide range of industries, including facilities management, engineering, telecommunications, hair and beauty, PR, fashion, leisure and entertainment, I.T., finance and banking, insurance, as well as having an in-depth knowledge of the recruitment industry. As a result Silverman Sherliker is on the REC's panel of recommended lawyers.

He is regularly asked to comment on live employment tribunal cases and employment law issues generally and has appeared on television broadcasts given by Channel 5 News (commenting on the John McCririck case), Hispania TV (commenting on the BBC’s difficulties with bullying and harassment claims), BBC News 24 (commenting on claims which could be brought by the News Of The World employees), Channel 4 News (commenting on the case of Villalba v Merrill Lynch & Co Inc [2007] ICR 469) and CNN (commenting on the World Health Organisations ban on recruiting employees who smoke).

Nick has also been regularly interviewed for Radio 4's PM & the Today Programmes and several programmes for Radio 5 Live, Radio London (The Vanessa Feltz Show), Colourful Radio and CHQR AM in Canada (The Rutherford Show).

Nick has been asked to provide comments for articles appearing in The Sunday Times, The Sunday Telegraph, The Times, The Telegraph, Metro, The Evening Standard, The Economist & The In-House Perspective. Nick is very regularly asked to providing comments to Lexis Nexis (a very well respected resource for lawyers) as well as participating as a panel expert in their CPD webinars.

Nick has been recognised in 2013 & 2014 by Chambers, which is a respected legal directory, as a Leading Individual in the field of Employment Law.

He is a member of the Employment Lawyers' Association and the British Italian Law Association. Nick speaks fluent Italian and reasonable French.

Nick is a London School of Economics law graduate and was admitted as a solicitor in 1990. After leaving McKenna & Co (now CMS Cameron McKenna) he moved to The Simkins Partnership (now Michael Simkins LLP). From a broad commercial litigation background his practice focused on employment law. He joined Silverman Sherliker as a partner in 1998 and has developed a thriving Employment & Pension Law Department which now comprises a total of 8 fee earners.

One thing you may be interested to know about Nick is that he is a Level 1 F.A. Licensed Coach and manages a youth football team most weekends of the year.
